RALLYTOON – TERMS AND CONDITIONS

These Terms and Conditions (the “Terms”) govern your access to and use of the website www.rallytoon.com (the “Site”) and all products and services offered by RallyToon, including custom illustrations (EVO1 and EVO2) and products available in the Fans Store. By using the Site or placing an order, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Site or order any products.

1. Company details and applicable law

RallyToon operates from Mexico, and these Terms are governed by the laws of the United Mexican States (Mexico), without regard to conflict of law rules.

The services are intended for adult users (18+). By using the Site or placing an order, you confirm that you are at least 18 years old or that you have the consent of a legal guardian.

2. Services provided

RallyToon provides, among other things:

  • Custom cartoon‑style illustrations created from rally‑related photos, in different options such as EVO1 and EVO2.

  • Digital products and artwork available for purchase in the Fans Store (for example posters, digital downloads, rally‑themed designs).

  • Other related creative services as described on the Site from time to time.

All products are delivered as digital files (for example downloads or email attachments), unless explicitly stated otherwise on the product page.

3. Ordering process

3.1 Custom orders (EVO1 / EVO2)

  • You send your photo(s) and instructions using the contact form, email, or any method indicated on the Site.

  • RallyToon reviews your request and confirms feasibility, price, and the applicable option (EVO1 or EVO2).

  • Your order is considered accepted only after full payment has been received.

  • An estimated delivery time may be communicated as an indication, but it is not a strict deadline. It may vary depending on workload, complexity, and technical constraints.

3.2 Fans Store products

  • For products available in the Fans Store, you select the item and follow the purchase process indicated on the Site.

  • Your order is confirmed once payment is accepted and you receive the confirmation email.

  • Delivery details (download link, file format, etc.) are specified on the product page or in the confirmation message.

RallyToon reserves the right to refuse or cancel any order, for example in case of suspected fraud, abusive behavior, or technical error.

4. Prices, currency and payment

  • Prices are generally displayed in USD, unless otherwise indicated.

  • RallyToon may modify prices at any time, but the applicable price is the one shown at the time of your order.

  • Payment must be made using the methods offered (for example credit card, PayPal, or other online payment services).

  • The order will only be processed after full payment is confirmed.

You are responsible for any bank fees, exchange rate costs, or charges applied by your payment provider.

5. No guarantee of specific result

RallyToon will use reasonable skill and care to deliver high‑quality artistic work, consistent with the chosen option (EVO1 / EVO2) and the description on the Site. However:

  • Artistic style, colors, and interpretation remain at the discretion of RallyToon.

  • RallyToon does not guarantee that the final result will match your personal taste, expectations, or subjective preferences.

No refund will be granted solely because you do not like the style or artistic choices of the final illustration.

6. Cancellations and refunds

Given the custom and digital nature of the products:

  • All paid orders are final and non‑refundable.

  • No refund will be provided in case of cancellation by you, change of mind, delay caused by your late delivery of photos or information, or dissatisfaction based on subjective taste.

If RallyToon becomes completely unable to perform the order (for example serious illness, long‑term technical failure, or legal impossibility), RallyToon may, at its sole discretion, propose an alternative solution, a credit, a partial, or full refund.

7. Photos, third‑party rights and warranties

By sending photos or content to RallyToon, you represent and warrant that:

  • You are the owner of the photos, or you have obtained all necessary authorizations from the photographer, rights holders, and any identifiable persons in the images.

  • The photos and content do not violate any copyright, trademarks, personality rights, image rights, privacy rights, or other rights of third parties.

  • The photos do not contain illegal, hateful, defamatory, pornographic, or otherwise inappropriate content.

You are fully responsible for the photos and materials you provide. You agree to indemnify and hold harmless RallyToon from any claim, damage, or legal action related to the use of such photos and content.

RallyToon may refuse or stop working on any photo or order that appears to violate these rules.

8. Intellectual property and licenses

8.1 EVO1 – Personal use only

For EVO1 (for example economy version with watermark or lower resolution), and unless explicitly agreed otherwise in writing:

  • You receive a personal, non‑exclusive, non‑transferable, worldwide license to use the illustration only for private, non‑commercial purposes (personal social media accounts, personal prints for home, etc.).

  • You may not use EVO1 illustrations for commercial purposes such as selling merchandise, posters, or using the artwork in advertisements, sponsorships, or branding.

  • You may not claim authorship of the artwork or resell the file as a standalone product.

8.2 EVO2 – Extended licence (personal and commercial use)

For EVO2 (for example high‑resolution version without watermark, with extended rights), and unless explicitly stated otherwise:

  • You receive a non‑exclusive, worldwide, perpetual license to use the illustration for both personal and commercial purposes (posters, banners, merchandise, team communication, sponsor communication, etc.).

  • You may integrate the illustration into your own products or promotional materials.

  • You may not resell or distribute the raw digital file as a stock image or claim that you created the artwork yourself.

  • You remain responsible for ensuring that your use of the illustration does not infringe third‑party rights (including trademarks, logos, and image rights of individuals).

8.3 RallyToon’s rights

In all cases:

  • RallyToon retains the underlying copyright and all intellectual property rights in the artwork, including style, composition, and graphic elements.

  • You must not remove or alter any copyright or attribution notices where present.

  • Any use not expressly granted in these Terms is reserved to RallyToon.

9. Motorsport drivers, public figures and teams

Some RallyToon artworks may be inspired by the general appearance of well‑known rally drivers, co‑drivers, cars, teams, liveries, or events that are visible in public competitions or widely shared motorsport imagery. Such references are made for artistic and descriptive purposes only.

  • RallyToon does not claim any endorsement, sponsorship, or official association with any driver, co‑driver, team, manufacturer, event organizer, or sponsor.

  • Names, race numbers, liveries, and logos that belong to third parties remain the exclusive property of their respective owners.

Where an illustration clearly focuses on a specific real‑world driver or public figure, any commercial use of that artwork (for example as merchandise, advertising, or promotional campaigns) may require separate permissions, licenses, or image‑rights consents from the relevant rights holders. RallyToon does not provide those permissions and does not guarantee that your intended use is legally permitted.

10. Fans Store – Image rights and portraits

The illustrations and designs offered in the Fans Store are artistic creations inspired by the general world of rally racing. They may depict cars, scenes, and environments that resemble real‑world situations, events, or styles. Any resemblance to specific persons, drivers, co‑drivers, team members, or spectators is not intentional unless clearly stated.

Under Mexican law, the portrait or image of a person (including photographs and any graphic representation that allows a person to be identified) is generally protected and may only be used or published with that person’s consent, subject to limited exceptions.

RallyToon does not knowingly create or sell Fans Store products based on private photos of identifiable individuals without permission. Reference material may include:

  • Generic rally imagery, public‑facing scenes and atmospheres.

  • Mixed or stylized references.

  • Original drawings and compositions by RallyToon.

The fact that certain images or videos may be visible on the internet does not place them in the public domain and does not remove copyright or image‑rights protection.

You are solely responsible for the way you use RallyToon illustrations after purchase, particularly where:

  • A real person might be identifiable.

  • A person’s name, likeness, or identity is associated with commercial messages, advertisements, endorsements, or products.

  • Local image‑rights, privacy, or personality‑rights laws may apply.

If you plan to use any illustration in a way that emphasizes a specific person (for example on commercial merchandise, advertising, sponsorship, or promotional campaigns), you must obtain any required image‑rights authorization or legal advice yourself. RallyToon does not provide legal clearance for the likeness of any person and does not guarantee that your intended use will be lawful.

To the maximum extent permitted by law, RallyToon will not be liable for any claim, damage, fine, or legal action arising from:

  • Your use of an illustration in violation of image‑rights, privacy, or personality rights.

  • Any association of an illustration with a specific person, driver, team, sponsor, or brand without their authorization.

  • Any modification, combination, or context chosen by you (including text, logos, or slogans added to the artwork).

You agree to indemnify and hold harmless RallyToon from any third‑party claim related to your use of the illustrations, including claims for violation of image rights, privacy, or reputation.

11. Customer‑added names, numbers, logos and content

Some RallyToon products and custom orders allow you to request the addition of specific names, race numbers, team names, logos, sponsors, or other text and graphic elements.

By requesting or providing such elements, you confirm that:

  • You have all necessary rights and permissions to use them and to have them included in the artwork.

  • You understand that trademarks, logos, brand names, and personal names may be protected by law.

You remain fully responsible for any legal consequences arising from the inclusion of these elements in the illustration and from your subsequent use of the final artwork (for example on clothing, stickers, posters, websites, or social media).

RallyToon does not verify the legality of customer‑provided content and assumes no liability for trademark, copyright, or image‑rights infringements caused by that content. You agree to indemnify and hold harmless RallyToon from any claim, damage, or expense (including reasonable attorney fees) related to the names, numbers, logos, or other content that you instruct RallyToon to include in an illustration.

12. Notice and takedown – IP and image rights

If you are a copyright owner, rights holder, team, driver, sponsor, event organizer, or individual and believe that any illustration or product on the Site violates your copyright, image rights, publicity rights, or other legal rights, you may contact RallyToon with:

  • Sufficient information to identify the work or product in question.

  • A description of the rights you claim are being infringed.

  • Your contact details and any supporting documentation.

RallyToon will review the request in good faith and may, at its sole discretion, modify, temporarily suspend, or permanently remove the content or product, and/or stop selling it, without admitting any liability. This voluntary “notice and takedown” mechanism is without prejudice to any rights that may exist under Mexican law.

13. Website use and prohibited conduct

You agree not to:

  • Attempt to damage, hack, or interfere with the proper functioning or security of the Site.

  • Use the Site for fraudulent or unlawful purposes.

  • Copy, scrape, or reuse substantial portions of the Site content without prior written consent from RallyToon.

RallyToon may suspend or terminate your access to the Site or services at any time if you breach these Terms or engage in unlawful behavior.

14. Liability and limitation of liability

To the maximum extent permitted by applicable law:

  • RallyToon will not be liable for indirect, incidental, special, or consequential damages, including loss of profits, loss of business, or loss of opportunity.

  • RallyToon is not responsible for printing errors, color differences, or technical issues related to your devices, screens, printers, or third‑party services.

  • Any dispute between you and a third party (such as a photographer, driver, team, sponsor, or event organizer) regarding photos or the use of an illustration is your sole responsibility.

If RallyToon’s liability is established for any reason, it will in all cases be limited to the total amount you actually paid for the order or product concerned.

15. Changes to these Terms

RallyToon may update these Terms from time to time, for example to reflect legal or technical changes. The version in force is the one published on the Site at the time of your order or use of the services.

Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
